The Government of Canada released an updated Ministerial Order on November 29, 2021, requiring federally regulated railways, including CP, to expand their mandatory employee COVID-19 vaccination policies to certain contractors.
CP has developed a mandatory COVID-19 Vaccination Mandate Policy that applies to contractors and their employees who access CP premises in Canada and have close contact with CP employees ("Contractors").
For the purposes of this Policy, "Contractor" means a person not directly employed by CP, but who is:
- An individual employed by an independent contractor that is retained to provide services to CP for a fee;
- an independent person retained by CP to provide a service for a fee; or
- an individual employed by a supplier of goods for CP,
and who enters onto CP premises and has close contact (defined as more than 15 minutes spent within two metres cumulative over a 24 hour period) with CP employees.
For further clarity, "Contractor" does not include couriers or other delivery contractors; dray, trucking or other material transportation service providers; contractors responding to an emergency situation; or contractors who provide services to third parties on CP premises.
CPs Contractor Vaccine Mandate Policy expectations are as follows:
- Effective December 10, 2021, any Contractor accessing CP property in Canada must have received at least one dose of a COVID-19 vaccine approved by Transport Canada and carry proof of vaccination credential, unless the individual is exempt from vaccination on medical or religious grounds.
- Effective January 24, 2022, any Contractor accessing CP property in Canada must be fully vaccinated and carry proof of vaccination credential, unless the individual is exempt from vaccination on medical or religious grounds.
- Effective December 10, 2021, any Contractor accessing CP property in Canada who is not fully vaccinated, including an individual exempt from vaccination, must carry a negative result from a COVID-19 test taken within 72 hours before they enter CP property.
- Exemptions from the vaccination mandate are very limited and must be in the forms provided by Transport Canada.
Contractor Proof of Vaccination and Testing
- At any time on CP premises, a Contractor may be asked to present their proof of vaccination credential, proof of exemption, and/or test result for inspection by a CP representative.
- Any Contractor who is not compliant with CPs Policy or who cannot present proof of vaccination, proof of exemption, and/or a current negative test result upon request, will be immediately removed from the property.
- It will be within CPs sole discretion to determine if or when a Contractor will be permitted to return to CP property following non-compliance and the minimum expectation will be proof of vaccination, proof of exemption, and/or a test result. In addition, there may be consequences under the terms of the agreement with CP for failure to comply with this regulatory requirement.
It is your responsibility as a contractor to ensure that all employees comply with this Policy.
